Updated arbitration rules
The Arbitration Institute of the Stockholm Chamber of Commerce has now become SCC Arbitration Institute. Following up on its rebranding, the SCC introduced a suite of changes to its institutional rules and procedures.
Below is a brief summary of the changes to the SCC Arbitration Rules.
- A new provision has been added to Article 32(2) (Hearings) specifying that the Tribunal shall decide whether the hearing shall be conducted in person or remotely.

Article 45(2) (Settlement or other grounds for termination of the arbitration) was modified to provide power for the tribunal to terminate the arbitration for any reasons apart from settlement by issuing a procedural order, not only by an award as was required by the previous version of the Rules.

The amendment to Article 29 (Written Submissions) clarifies the information to be included in the statements of claim and defence. The wording "the facts and other circumstances" in the revised article replaces "the factual and legal basis of the claim" in the previous version of the Rules, and the modification can thus be expected to have limited practical impact on the arbitration proceedings.

Article 51(5) (Advance on costs) now allows a Tribunal to terminate the case in the event of non-payment of the advance on costs after the case has been referred to the tribunal. In the previous version of the Rules, it was only the Board that had the power to dismiss the case before or after the referral of the case to the Tribunal.

2023 Arbitration Rules now reflect the SCC’s change of name from the Arbitration Institute of the Stockholm Chamber of Commerce to the SCC Arbitration Institute.

The wording of a few articles was modified as a result of various language revisions.

The removal, as a recommended addition to the SCC model clause, agreement on the number of arbitrators.

A revised schedule of costs is also in force as of 1 January 2023, applicable to proceedings commencing on or after that date.
