Reconstruction and insolvency
Since the banking and financial crisis in the 1990s, DLA Piper's Reconstruction and insolvency team has handled many of the largest and most complicated company reconstructions and bankruptcies in Sweden.
Our focus is primarily to save businesses with problems and to help them getting a "second chance/fresh start" through informal or formal company reconstruction procedures. If the prerequisites for a reconstruction are not met, we instead assist in dissolving the business with or without bankruptcy proceedings. The team regularly works integrated with the law firm's other competence groups, mainly with the Corporate group and Banking and Finance, which means that we can give qualified advice throughout all stages of the operating circle, when a company has, or risk getting, financial problems. If necessary, we involve all the additional competence the matter requires to our team, which include labor law, property law, intellectual property law and tax law. DLA Piper in Stockholm is part of DLA Piper's Nordic and global reconstruction teams. DLA Piper works coordinated in all jurisdictions and has a long experience of cross-border matters.
Together with the law firm's Litigation group, we also focus on Forensic. In addition hereto, we can assist our clients with mediation in the field of reconstruction, in order to resolve deadlocks between the debtor and creditor, as well as within groups of debtors, a procedure which has turned out to be extremely successful, in i.a. USA and the Anglo-Saxon world.
